“Special Order Items” refers to non-stock, customised, or made-to-order products.

  • Manufacturer specifications may change without notice.
  • Technical data sheets must be consulted before installation.
  • The Buyer is solely responsible for confirming product suitability for their intended use.

Any advice provided by GKS Builders Yard (by email, phone, or otherwise) is general guidance only and should not be considered professional or technical advice.

5. Prices and Payment

  • All prices include VAT unless stated otherwise.
  • Delivery charges are calculated and displayed at checkout.
  • Payment must be made in full before goods are dispatched, pay on delivery options are also available
  • We reserve the right to alter prices without notice.
  • Orders may be refused if payment fails, stock is unavailable, or an error is identified.

6. Ordering and Order Acceptance

Placing an order constitutes an offer to purchase goods. A legally binding contract is formed when:

  • We send an order confirmation email, or
  • We dispatch the goods.

We reserve the right to decline orders for reasons including stock shortages, pricing errors, suspected fraud, or unsuitable delivery locations.

7. Special Order Items

Special Order Items include, but are not limited to:

  • Tinted or colour-mixed silicone renders and paints
  • Insulation components not normally held in stock
  • Cut-to-size or bespoke products
  • Bulk quantities ordered specifically for the Buyer

Special Order Items cannot be cancelled or returned unless defective.

8. Delivery Policy

Delivery Method

Goods may be delivered by pallet courier, van delivery, or standard parcel service. Delivery is kerbside only unless otherwise agreed.

Delivery Times

Estimated delivery times are provided at checkout. These are estimates only and not guaranteed.

We are not liable for delays caused by weather, supply issues, courier networks, or any factors beyond our control.

Access Requirements

Buyers must ensure:

  • Adequate access for delivery vehicles
  • Someone is available to receive the goods
  • Delivery details are accurate and safe

Failed deliveries may incur additional charges.

Risk and Title

Risk in the goods passes to the Buyer upon delivery.

Ownership of the goods passes to the Buyer once payment has been received in full.

9. Inspection of Goods

Buyers must inspect goods on delivery.

Any damages, defects, missing items, or incorrect items must be reported to us within 48 hours of delivery.

Photographic evidence may be requested to support a claim.

Failure to report issues within this timeframe may affect the Buyer’s right to a refund or replacement.

10. Returns and Refunds

  • Returns must be requested within 21 days of delivery.
  • A 20% restocking fee applies unless goods are defective or the return is due to our error.
  • Goods must be unused, unopened, and in their original packaging.
  • Delivery costs are non-refundable.
  • Return shipping costs must be covered by the Buyer unless otherwise agreed.
  • The following items cannot be returned:
    • Tinted or colour-mixed products
    • Special Order Items
    • Hazardous materials
    • Cement-based or perishable materials
    • Bespoke, cut-to-size, or made-to-order goods

11. Warranty

Goods may be covered by a manufacturer’s warranty.

GKS Builders Yard does not provide installation warranties or guarantees.

Warranty does not apply if:

  • Goods were installed incorrectly
  • Storage conditions were unsuitable
  • Manufacturer instructions were not followed
  • Goods were used for a purpose outside their intended application

12. Liability Limitations

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential losses including lost labour, project delays, or loss of profit.

  • Our total liability is limited to the value of the order.

  • Buyers are responsible for confirming product suitability for their intended use.

  • We are not responsible for losses resulting from reliance on general advice or verbal guidance.

Nothing in these Terms limits liability for death or personal injury caused by negligence.

13. Technical Advice Disclaimer

Any advice provided by GKS Builders Yard, whether written or verbal, is general guidance only.

The Buyer must:

  • Consult manufacturer technical data sheets
  • Verify correct installation methods
  • Ensure compliance with building regulations
  • Confirm system compatibility

We do not accept liability for issues arising from reliance on informal or non-technical advice.

14. Intellectual Property

All content on the website, including images, descriptions, branding, graphics, and layout, is the property of GKS Builders Yard.

Content may not be copied or reproduced without written permission.

15. Privacy and Data Protection

We process personal data in accordance with UK GDPR and the Data Protection Act 2018.

16. Governing Law
